Stork Roofing Terms and Conditions

Welcome to Stork Roofing ("we," "our," "us"). These Terms and Conditions govern the provision of roofing services ("Services") to our clients ("you," "your"). By engaging us for roofing services, you agree to be bound by the terms and conditions set out below. Please read these terms carefully.

1. Services Provided

We offer various roofing services, including installation, repairs, and maintenance. All services will be performed as agreed upon in the quotation, which includes a description of the scope of work and estimated costs.

2. Quotations

- All quotations provided by us are valid for 14 days unless otherwise stated in writing.

- Quotations are based on the information provided by the customer at the time of assessment. While we strive to provide accurate quotations, unforeseen circumstances (e.g., hidden damages or structural issues) may lead to additional charges.  Any additional costs will be communicated and agreed upon in writing before proceeding.

- We reserve the right to amend the quotation if unforeseen circumstances arise during the work.

3. Scope of Work

- The scope of the work will be detailed in the quotation provided to you

- Any additional work required that is not covered by the original quotation will be discussed and quoted separately.

- We will make reasonable efforts to complete the work within the agreed time frame; however, we are not responsible for delays caused by weather, supply chain issues, or other circumstances beyond our control.

4. Payment Terms

- A deposit may be required prior to the commencement of work, unless otherwise agreed.

- Full payment is due within 7 days of the invoice being issued unless specified differently in the quotation or contract.

- We accept payments by bank transfer or cheque.  Payments by credit/debit card will incur an additional 3% fee.

- Late payments may incur interest at the base rate plus 8%, calculated per day until the balance is settled. In addition, a £200 debt collection fee may be charged.

5. Materials

- We use high-quality materials for all our work. If specific materials are required by you, this must be agreed upon in writing before the work begins.

- All materials remain the property of the company until full payment is received.

6. Project Timelines

- We will make every effort to start the work on the agreed date, subject to weather conditions, progress of preceding works and availability of materials.

- Any delays outside our control (e.g., severe weather conditions, supply chain issues) will be communicated to you promptly. We will not be liable for any loss or inconvenience due to these delays.

7. Workmanship and Materials

- We provide a discretionary workmanship warranty from the date of completion of the project.

- The warranty does not cover damages caused by misuse, neglect, or external factors such as weather-related incidents or third-party work.

- Any issues arising during the warranty period must be reported in writing to us promptly.

- Any issues relating to the materials used will be referred to the manufacturer’s warranty terms.

8. Photography

- The provision of photos is not obligatory under this agreement.

- The absence of photos does not affect the validity or execution of the agreement.

- Photos provided remain the intellectual property of the party who created or owns them.

- No rights to the photos are transferred to other parties unless explicitly stated otherwise in a separate agreement.

- Any photos provided should be treated as confidential and should not be disclosed to third parties without explicit permission.

- The party providing photos will not be liable for any issues arising from the use of the photos by other parties.

- The party receiving photos is responsible for ensuring that their use complies with all applicable laws and regulations.

- The provision of photos by us may incur additional charges. These charges will be communicated in advance and must be agreed upon before the photos are provided.

9. Customer Responsibilities

- You must ensure the work area is clear of any personal items or obstructions prior to the commencement of work.

- You must ensure that any necessary permissions or consents (e.g., planning permission) are obtained before the work begins.

- You agree to provide access to the property and necessary utilities (such as electricity and water) during the course of the work.

- You agree to ensure that the worksite is safe for our employees and subcontractors at all times.

10. Cancellation Policy

- Cancellation by You: If you cancel the project before work begins, you will forfeit the deposit (if a deposit has been paid). If work has already started, you will be liable for payment for any work already completed, including materials purchased.

- Cancellation by Us: We reserve the right to cancel the contract if:

  • There are significant changes to the scope of work that were not foreseen or communicated to us during the initial inspection.

  • We are unable to carry out the work due to safety concerns or non-compliance with building regulations.

  • You provide false or misleading information

11. Health & Safety

- We adhere to all health and safety regulations, ensuring that all work is carried out in a safe manner.

- You must inform us of any known hazards or risks on-site prior to the commencement of the work.

12. Liability

- We are not liable for any loss or damage that occurs due to events outside of our control (e.g., adverse weather conditions, delays in material supply).

- We will not be liable for any indirect, consequential, or financial losses arising from the delay or inability to complete the work.

- We will take all necessary precautions to avoid damage to your property. However, we will not be held liable for minor incidental damage (e.g., to landscaping, pathways) unless negligence is proven.

- Our total liability in respect of any contract shall not exceed the total amount paid by the customer to us for the work undertaken.

13. Complaints Procedure

- If you are dissatisfied with any aspect of our services, please contact us in writing within 14 days of the completion of the work. We will aim to investigate and resolve the issue as soon as possible.

14. Insurance

- We hold public liability insurance of up to cover accidental damage or injury caused during the provision of our services.

- You are advised to ensure that your own property insurance is adequate to cover any risks involved during the roofing work.

15. Governing Law

- These Terms and Conditions shall be governed by and construed in accordance with the laws of Scotland. Any disputes arising from this agreement shall be subject to the exclusive jurisdiction of the courts of Scotland.

16. Privacy Policy

- We collect and store personal information as necessary to carry out our services. We are committed to protecting your privacy and will not share your details with third parties without your consent, except as required by law.

17. Amendments

- We reserve the right to update these terms and conditions at any time. Any changes will be communicated to you in writing prior to the commencement of any new work.

18. Force Majeure

- We shall not be held liable for any failure to perform any obligation under this agreement if such failure is caused by circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, civil disturbance, strike, or extreme weather conditions.

19. Entire Agreement

- These Terms and Conditions, along with any written quotation or contract, constitute the entire agreement between you and the company. No other terms or conditions, whether verbal or written, will apply unless agreed in writing by both parties.
